Kirsty Allen, of Oxford Street, Grimsby, walking down the road did pay much heed to the piece of fruit dropped on the road by her 16 month old son. But the Council members did take offense and issued her a ticket.
Though the mother claims, '' The banana peel just rolled off his hand from the pram. I didn't really think of it as litter as I thought it would either be eaten by birds or just decompose."
The council came up with another version of Allen's events. John Waite, the council's interim environmental enforcement manager, said: ''It is standard procedure to issue a fixed penalty notice to anybody who is caught littering. This incident was identified as an offense within the Cleaner Neighborhoods Environment Act 2005 as the resident was caught discarding the skin of a banana.The offense was acknowledged by Mrs Allen and the council's community wardens spoke to her about the consequences of waste being discarded."
